Mediation Essential Pillar of Justice System, Says Chief Justice Torkornoo.

ACCRA: Chief Justice Gertrude Torkornoo has emphasized the importance of mediation as a fundamental component of a balanced and responsive justice system, highlighting its role in enhancing access to justice. In a speech delivered on her behalf by Justice Patricia Quansah at the launch of 'The Mediation Bridge,' an alternative dispute resolution company, Torkornoo advocated for the promotion of mediation to create a more robust justice system.According to Ghana News Agency, Chief Justice Torkornoo described mediation as a hopeful vehicle for equitable access to justice, providing an efficient and empowering solution for individuals seeking to resolve disputes. She noted that mediation fills the gap often left by the formal court process in Ghana, particularly in an era where courts are overwhelmed with cases, and serves as a beacon of efficiency and accessibility.Torkornoo explained that mediation offers a non-adversarial proceeding where a neutral arbiter helps clarify the parties' positions and generate options for mutually satisfactory solutions. She highlighted the significant elements of confidentiality and informality in mediation, which allow parties to control the process and decide whether to terminate or proceed if an agreement is not reached. She also mentioned that Ghanaian courts offer alternative dispute resolution to manage the growing volume of cases, leading stakeholders to seek methods beyond traditional litigation. The Mediation Bridge, she noted, plays a crucial role in providing dispute resolution training to judges and magistrates in Ghana.Mr. Christopher Essilfie, President of The Mediation Bridge, remarked that the initiative marks a milestone in fostering community dialogue and harmony. He emphasized mediation's deep roots in cultural heritage and its historical role in resolving disputes and maintaining peace, often with win-win outcomes and at minimal cost.Essilfie pointed out that traditional leaders have long settled disputes with wisdom and patience, strengthening communal bo nds. He noted that while the power of Chiefs has diminished with legal changes, there is potential to transition from litigation to constructive conflict resolution, reducing strain on legal systems and honoring cultural traditions. He concluded by stating that the launch of The Mediation Bridge offers an opportunity to commit to peaceful resolution and cultural collaboration, promoting understanding and respect in conflict resolution.
