‘Sata within law’

THE Supreme Court has ruled that President Michael Sata was within the law to appoint a tribunal to probe the conduct of three judges he suspended last year.

 

Delivering a four-hour judgment yesterday, acting Chief Justice Lombe Chibesakunda, on behalf of a bench of seven judges, ruled that President Sata did not breach his Constitutional powers when he suspended the trio and the subsequent setting up of the tribunal.

The three affected judges are Phillip Musonda of the Supreme Court and two High Court judges, Nigel Mutuna and Charles Kajimanga.

Ms Justice Chibesakunda, sitting with her deputy Florence Mumba, and Justices Marvin Mwanamwambwa, Hildah Chibomba, Gregory Phiri, Muyinda Wanki and Elizabeth Muyovwe, however, advised the State not to go ahead with the tribunal due to the nature of the case.
