Zambia’s former president Rupiah Banda can still be investigated with his immunity, the Anti-Corruption Commission has insisted.

Reacting to calls that Banda enjoys immunity from prosecution according the country’s constitution, the ACC says investigations into Banda’s alleged corruption and other criminal activities can still be investigated with his immunity. The Commission’s Head says the immunity only prevents him from prosecutions and not investigations.

Sakwiba Sikota who is the former president’s lawyer has written to ACC stating that his client will not report for questioning at the Commission as he still enjoys immunity. He explained that he will not allow Banda to be tried into the media adding that the former president can only be summoned after lifting his immunity.

Banda will therefore not report for questioning on Thursday, February 7, 2013 as summoned by the ACC, Sikota has said.
