Offences committed when abuse of authority office was repealed are prosecutable – DPP

DIRECTOR of Public Prosecutions (DPP) Mutembo Nchito has told the Lusaka Magistrate Court and Rupiah Banda’s lawyers that offences which were allegedly committed during the period the law on abuse of authority of office was repealed, are prosecutable.

This was after lawyers representing Banda asked the Lusaka Magistrate’s Court to refer the matter where the former head of state is charged with abuse of authority of office to the High Court for determination of constitutional issues.

Banda’ lawyers comprising of Prof Patrick Mvunga, Eric Silwamba, Sakwiba Sikota, Lubinda Linyama and Steven Lungu have argued that their client was charged under a repealed law.

But Nchito has argued that there were no constitutional issues in the case before court.

In this case, Banda is charged with abuse of authority of office contrary to section 99 (1) of the Penal Code Chapter 87 of the Laws of Zambia.
