High Court Revokes Simwiya’s Deportation

Court1-300x266The Lusaka High Court has revoked the deportation of Ndola businessman Abdul Simwiya to Angola and described the action as outrageous.Home affairs minister Edgar Lungu last month deported Simwiya after linking him to Al-Qaeda.

Lusaka High Court judge Chalwe Mchenga said Lungu’s decision was not only outrageous but misplaced and could therefore not stand.

Judge Mchenga said home affairs minister Edgar Lungu erred to order the deportation of Simwiya without following proper procedures.

Judge Mchenga said government’s decision to deport Simwiya was devoid of natural justice and that the right decision was to dismiss the order.

Last month, Lungu deported Simwiya on allegations of being a threat to national security.
