HH quest to stop case dismissed

THE LUSAKA High Court has dismissed an application in which United Party for National Development (UPND) president Hakainde Hichilema sought to have the case in which he is charged with publication of false news stopped.

Mr Hichilema’s lawyers applied to the High Court that the matter before chief resident magistrate Joshua Banda should be halted pending determination of constitutional issues.But High Court judge Christine Phiri said in a ruling delivered on January 17 that Mr Hichilema’s application lacks merit.”I have considered the application carefully and I have referred to the submissions of both the applicant’s [Mr Hichilema’s] counsel and respondent’s counsel. I have further referred to the authorities filed in the application. This application lacks merit as it is frivolous and I accordingly dismiss it with costs. However, I order that the criminal matter proceeds in the court below,” Ms Justice Phiri said.
